Gossip Girl star Kelly Rutherford 'files for bankruptcy' after 'spending $1.5million on divorce and custody battle' with ex-husband

Another blow: Kelly Rutherford has filed for bankruptcy

She currently must fly from America to Monaco in order to see her two children with her ex-husband after he was controversially awarded custody.

And Kelly Rutherford’s good luck still seems to have run out as the Gossip Girl star has now filed for bankruptcy, it has been claimed.

The actress has apparently spent $1.5million on legal fees from her bitter divorce and custody battle with Daniel Giersch.

She is claiming debts of $2,021,832 with assets totalling $23,937, according to court documents obtained by TMZ.

The website reports that Kelly has filed for Chapter 7 bankruptcy after asking the family law judge to make Daniel pay for the extensive legal fees.

Gossip Girl wrapped late last year and Kelly’s monthly income has since dropped from $486,000 to a significantly more modest $1,279.33.

In addition reports state that the actress, also known for starring in Generations and Melrose Place, owes over $350,000 in income taxes for 2012 and $25,251 in Amex charges.

According to the bankruptcy petition, which was filed last month, Kelly has $11,487 in her checking account.

The 44-year-old also allegedly has around $5000 in furniture, $5000 in clothes and $1500 in jewellery.

Kelly has borrowed money in the sum of thousands of dollars from friends and family in a bid to aid her financial situation.

Kelly left Daniel in 2009 while pregnant with their second child after the German businessman’s visa was revoked, a judge awarded him custody of the children last year.

She has said she is forced to live with a friend while she continues to fight for her children, Hermes, six and Helena, three, to live with her in New York.

'Having to peel my son off my body, screaming, "Mama, save me!" when I had to give him to his father—not because he doesn't love his dad, but because he's too young and it was like a forced thing,' Rutherford recently said.

Kelly compared going to visit her children and then coming home without them to 'being in a park full of laughing happy children, and then the next day you walk by the park and it's empty.'

Speaking to E! News the actress said she has made over 40 trips to Europe to see her children.

She said she has 'spent every penny. Every penny from Gossip Girl, my pension, my stocks has been spent fighting for my children.'
